Each customer, subscriber and/or affiliate of The Equalizer365™ also registered as TheEqualizer365™ agrees to all the terms and conditions contained herein and holds The Equalizer365™, TheEqualizer365™ (EQZ365), TheEqualizer365™ Pad free from any and all liability that may result from this agreement between the customer, subscriber, affiliate and The Equalizer365™.com, TheEqualizer365™.com and/or Eqz365.com. From here foreword the company/website shall be referred to as TheEqualizer365™ or the Equalizer365™.

Customers and subscribers may fill in their Affiliate Information with The Equalizer365™ at no additional charge. Customers and subscribers do not and are not eligible to receive or earn commissions if their affiliate information is not completely filled in.

If customers and subscribers wish to receive commissions, the customer and/or subscriber must fill in their personal Information on their Account page of the Equalizer365™ which is free to do so. Affiliates receive and earn commissions on the sales of The Equalizer365™ Pad, BOEQZ™ pad and The Strategies (See Commission Earnings below for complete details). As an independent affiliate, you agree that you are an independent contractor and are not subject to withholding, nor entitled to any other benefits, entitlements, or accommodations other than those legally provided for in the Commission Earnings portion of these terms. All liabilities for taxes, record keeping, reporting of state, national, or local taxes and/or licenses are the sole responsibility of the affiliate.

Being an affiliate of the Equalizer365™ does not represent being a partner, part owner, a subsidiary - stated or implied in any way whatsoever. An affiliate is an independent contractor and does not work for the Equalizer365™ company. Association with the Equalizer365™ company is strictly as an independent contractor also known as an affiliate.

Guaranteed Income

As an independent affiliate, you agree that neither TheEqualizer365™ nor any of its customers, subscribers or affiliates have guaranteed or implied any income, whatsoever. Any income that may be received by you as an independent affiliate of The Equalizer365™ will be solely based upon the sale of The Equalizer365™ Pad and Strategies. As an independent affiliate of the Equalizer365™, you agree you will not make any claims of income, or guarantee of income, either directly or indirectly.

Corporate Promotional Material

All promotional material for promoting The Equalizer365™ is provided by the company. However, affiliates may promote the Equalizer365™ using their own generic referral methods as long as the generic advertising (email, ads, solo ads, PPC advertising, newspaper, magazines, etc.) is within company guidelines of income projections, etc. As an affiliate you agree not to use the company’s name (including The Equalizer365™, Equalizer365™.com, EQZ365, Binary Options Equalizer™, BOEQZ™) in any form of advertising, be it email, ads, solo ads, PPC advertising, newspaper, magazines, etc., unless provided by the company. You also agree that you fully understand that using the name of any of the above-mentioned is grounds for immediate termination which includes forfeiting any current and all future commissions due as well as forfeiting any and all referred customers and/or other affiliates associated with your personal name, company name and your Equalizer365™ company ID and affiliate website.

As an affiliate you are not allowed to talk about the company.  

 
Spam Policy

In order to protect our customers, subscribers and affiliates and to ensure the long-term growth and success of TheEqualizer365™, the company maintains a ZERO tolerance policy toward the sending of spam email. Spam email is defined as Unsolicited Commercial Email (UCE). In the event that you send spam email to people without their permission, you risk immediate cancellation of your account and forfeiture of all contacts and commissions in that account. As an affiliate, you understand that TheEqualizer365™ neither condones nor tolerates the sending of spam email by its customers, subscribers or affiliates. You understand and acknowledge that: Any customer, subscriber or affiliate who violates this policy will have their account terminated, without refund, and without recourse. You may view the CAN-SPAM Act at the link directly below which is provided by the Federal Trade Commission.

Here’s a rundown of the law’s main provisions:
It bans false or misleading header information. Your email’s “From,” “To,” and routing information – including the originating domain name and email address – must be accurate and identify the person who initiated the email.

It prohibits deceptive subject lines. The subject line cannot mislead the recipient about the contents or subject matter of the message.

It requires that your email give recipients an opt-out method. You must provide a return email address or another Internet-based response mechanism that allows a recipient to ask you not to send future email messages to that email address, and you must honor the requests. You may create a “menu” of choices to allow a recipient to opt out of certain types of messages, but you must include the option to end any commercial messages from the sender. Any opt-out mechanism you offer must be able to process opt-out requests for at least 30 days after you send your commercial email. When you receive an opt-out request, the law gives you 10 business days to stop sending email to the requestor’s email address.

You cannot help another entity send email to that address, or have another entity send email on your behalf to that address. It’s illegal for you to sell or transfer the email addresses of people who choose not to receive your email, even in the form of a mailing list, unless you transfer the addresses so another entity can comply with the law.

It requires that commercial email be identified as an advertisement and include the sender’s valid physical postal address. Your message must contain clear and conspicuous notice that the message is an advertisement or solicitation and that the recipient can opt out of receiving more commercial email from you.

2008 CAN-SPAM Law Update - The new rule provisions address four topics: (1) an email recipient cannot be required to pay a fee, provide information other than his or her email address and opt-out preferences, or take any steps other than sending a reply email message or visiting a single Internet Web page to opt out of receiving future email from a sender; (2) the definition of “sender” was modified to make it easier to determine which of multiple parties advertising in a single email message is responsible for complying with the act’s opt-out requirements; (3) a “sender” of commercial email can include an accurately registered post office box or private mailbox established under United States Postal Service regulations to satisfy the act’s requirement that a commercial email display a “valid physical postal address”; and (4) a definition of the term “person” was added to clarify that CAN-SPAM’s obligations are not limited to natural persons.

Profanity, Hate, Violence or Illegal Matter

Any and all material/advertising copy containing profanity, hate, violence or illegal matter is strictly prohibited. Therefore any customer using profanity, hate, violence or illegal matter while promoting or advertising The Equalizer365™ will have their account immediately deleted at our discretion. The customer, subscriber or affiliate agrees to indemnify and hold harmless any other customer, subscriber, affiliate or The Equalizer365™ from any claims resulting from the use of the services that damage other customers and subscribers or affiliates, or any other parties.

Billing

The Equalizer365™ shall initiate debits or request payment for each one of The Equalizer365™ Pads purchased on a monthly basis. The Equalizer365™ shall initiate debits or request payment for Strategies on a one-time basis for each strategy purchased. Customers, subscribers and affiliates are responsible for providing and maintaining up-to-date payment information. The Equalizer365™ will not be held liable should customer’s, subscriber’s or affiliate’s payment information become outdated, invalid, or inaccessible at Clickbank for any reason. Accounts are in default if the payment information on file becomes outdated, invalid, or inaccessible.

CLICKBANK HOLDS ALL PERSONAL BILLING INFORMATION AND The Equalizer365™ HAS NO ACCESS TO THIS INFORMATION.

Affiliate Responsibilities

It is the affiliate’s responsibility to maintain his/her Account, Affiliate and Personal Information with the most recent and current information. All liabilities for taxes, record keeping, reporting of state, national, or local taxes and/or licenses are the sole responsibility of the affiliate. This includes any and all affiliate information on Clickbank.

Commission Earnings

The Equalizer365™ pays commissions to qualified affiliates based on the sales of The Equalizer365™ Pad and Strategies.  Affiliates who earn commissions earn a full 25% minus Clickbank fees of the monthly cost of each of The Equalizer365™ Pads sold through the referring affiliate's efforts. That is 25% minus Clickbank fees of the initial purchase price of The Equalizer365™ Pad and 25% minus Clickbank fees each month thereafter. Affiliates also earn 25% minus Clickbank fees of the one-time sale of each Strategy purchased by his referral.  Earned commissions will be paid through Clickbank to U.S. and international affiliates who qualify to receive commissions.

Affiliates will be paid using Clickbank. It is the responsibility of the affiliate to keep his/her own information current and up to date so that he/she receives a successful payment from Clickbank. There are no exceptions. The Equalizer365™ uses what we believe to be the best online payment services to fit the needs of the company, its customers and subscribers and affiliates. The Equalizer365™ takes no responsibility for the actions, reliability, or accessibility of any online payment service or processor. The Equalizer365™ uses Clickbank to take care of account setup, maintenance, paying of affiliate commissions and order-related support needs which relate to the purchase of The Equalizer365™ Pad and/or Strategies.

Affiliate Commissions

 Note – there is a 60-90 day processing period with our pay plan. What this means is, from the date you sign up until we process you very first commission check it takes 60 to 90 days to make sure all payments the company receives has cleared before any commissions are figured and checks are mailed. All commissions and checks are figured and mailed by the 15th of the month. There are no exceptions.


Refunds

After the initial 60 days of the purchase of The Equalizer365™ Pad, there are absolutely no refunds given. If a refund is given within the 60 days, the subscriber’s or affiliate’s Equalizer365™ account will be automatically and immediately shut down and the subscriber’s or affiliate’s account will be terminated. The subscriber or affiliate will also lose all referrals and commissions coming from those referrals. All referral information will be lost. To reinstate a subscriber’s or affiliate’s Equalizer365™ account, the subscriber or affiliate will need to pay the full initial price for purchase of The Equalizer365™ Pad and/or Strategies. If any refund is requested for any product - the Equalizer365™ Pad and/or the Strategies - the subscriber’s or affiliate’s account will be terminated. To be reinstated the subscriber or affiliate will also need to contact management of the Equalizer365™ and explain the reason for the refund and termination. It is at the sole discretion of management to decide if the subscriber or affiliate will be reinstated.

Communication With Customers, Subscribers And Affiliates

All personal information submitted from customers, subscribers or affiliates is kept in strict confidence and is not sold or shared with any third party except Clickbank which is needed for integration purposes.

All Customers, Subscribers and Affiliates will accept all forms of communication from the admin of the Equalizer365™. This is to include: email, written material via postal delivery, phone calls or phone messages. Such communication shall include but not be limited to: program updates, sales material, new product announcements, etc. It is the Customer’s, Subscriber’s and Affiliate’s responsibility to keep all communication information current such as email, address and phone number.

Terms and Termination

This agreement is effective until terminated. A customer, subscriber or affiliate of TheEqualizer365™, BOEQZ™  may terminate this agreement by cancelling their subscription for TheEqualizer365™ Pad, BOEQZ™ Pad at Clickbank. Customer’s, subscriber’s and affiliate’s rights under this agreement will terminate immediately without notice from TheEqualizer365™ if a customer, subscriber or an affiliate fails to comply with any provision of this agreement.

Warranties

The Equalizer365™ makes no warranties of any kind, whether expressed or implied, for The Equalizer365™ Pad, BOEQZ™ Pad, Strategies or any information it is providing. The Equalizer365™ will not be responsible for any damages suffered. This includes any loss resulting from interruptions, delays, non-deliveries, miss-deliveries of service caused by any customer, subscriber or affiliate errors or omissions, loss of electricity or natural phenomenon. Use of any information obtained via The Equalizer365™ is at your own risk. The Equalizer365™ specifically denies any responsibility for the accuracy or quality of information obtained through its services. The Equalizer365™ is not responsible for any data loss due to computer glitches or other instances that may be out of the control of The Equalizer365™.

In using The Equalizer365™, you agree that: The Equalizer365™ is a service provided “as is” with no guarantees or implied warranties whatsoever.  It is necessary for your IP address, name and email address to be logged for security reasons, to prevent abuse of the service, and to receive the The Equalizer365™ updates.

You will accept, review and keep the confirmation/thank you emails sent out by TheEqualizer365™ which include important information about your login and site submission. You will enter or add the TheEqualizer365™ email address into your address book/contact list to make sure you receive all emails. This address is:  admin@eqz365.com

You may discontinue your Equalizer365™ Pad subscriptions at any time. Contact Clickbank.com for that information. However, The Equalizer365™ does not prorate for any reason, therefore you will not receive any money back from discontinued service(s). You will also lose your Referrals information.  To begin your Equalizer365™ Pad subscription again after your service has been discontinued, you must pay the initial Equalizer365™ Pad monthly fee.

Modification of Services

All customers, subscribers or affiliates acknowledge and agree that The Equalizer365™ may, with or without notice, modify, delete, or amend the services, commissions, marketing material, and/or website provided hereunder. Further, customers, subscribers or affiliates acknowledge and agree that The Equalizer365™ may further modify, delete or amend the Terms of Agreement from time to time, including charging or changing a fee or fees for some services. In either event, The Equalizer365™ will notify customers, subscribers or affiliates of any modification, deletion or amendment on the website by email. If a customer, subscriber or an affiliate does not accept the modification, deletion or amendment, the customer, subscriber or affiliate must terminate customer’s, subscriber’s or affiliate’s relationship at that time. Any and all use of The Equalizer365™ or the services by customer, subscriber or affiliate after the notice is posted shall be deemed to be acceptance of the modification, deletion or amendment (as well as all other terms and conditions) to the services, website or Terms of Agreement.

Limitation of Liability

To the fullest extent permissible pursuant to applicable law, neither TheEqualizer365™ nor any parent entities, affiliates, officers, or employees shall be liable for any direct, indirect, special, incidental, consequential or punitive damages arising out of customer’s, subscriber’s or affiliate’s access to, use of, inability to use, or reliance on the service, the materials on or through the service or the website, or with any of the terms of agreement. Customer’s, subscriber’s and affiliate’s sole and exclusive remedy is to discontinue using the service and website. Should any provision of this agreement be held to be illegal, invalid, or unenforceable by a court of law, the legality, validity and enforceability of the remaining provisions of this agreement shall remain unaffected thereby unless otherwise stated.

This agreement shall be governed by the laws of the State of Minnesota and the United States.

These Terms and Conditions, last modified on July 20, 2011 - July 3, 2015, supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with Terms and Conditions of any order submitted.

Use of TheEqualizer365™ services constitutes acceptance of these Terms and Conditions.

Earnings Disclaimer

As an independent customer, subscriber or affiliate of TheEqualizer365™, you agree you will not make any claims of income or guarantee of income, either directly or indirectly.

As an independent affiliate of TheEqualizer365™, it is suggested that you visit and read through the FAQs and all of the site before you start promoting TheEqualizer365™ opportunity. The better acquainted you are with the TheEqualizer365™ opportunity, the better you should do in your marketing efforts. Knowing the full scope of what makes TheEqualizer365™ such a great business/opportunity will be a great benefit to any affiliate who is promoting the TheEqualizer365™.

This is the total amount you have won from placing wagers. This amount is figured by taking your Total Win and subtracting your Cumulative Wagers on the Equalizer365™ Pad.

Commissions can be earned from one-time purchases (Strategies) and also from on-going monthly subscriptions when a person who has been referred to the Equalizer365™ website purchases one or more of the Equalizer365™ Betting Pads.

Wager in which the first two finishers must be picked, but the payoff is made no matter which of the two wins and which runs second.

Our term for when you place your first bet into the Equalizer365™ Pad until you have a win and made a profit. Then you start a new session. A session can contain as little as 1 bet up to many bets until you have won and have made your profit.

Any 2 horses that are entered in a race as one entry. If you place a wager on one of the horses and the other horse comes in, you still win the race. The amount of the payout per wager is the same for both horses.

Reviewing the race to check into a possible infraction of the rules.
